Orbitalynx Labs provides professional virtual reality design, development, production, and consulting services. These terms do not create a partnership, employment relationship, joint venture, franchise, or agency relationship between you and Orbitalynx Labs.
2. Services We Provide
Orbitalynx Labs designs and develops immersive virtual reality solutions for enterprise training, education, simulation, and interactive experience projects. Our services may include:
- VR training simulations for workplace instruction, procedure rehearsal, safety learning, and skills development.
- VR experience design and prototyping, including UX structure, interaction flows, interface concepts, and rapid functional prototypes.
- 3D asset production and virtual environment creation, including props, spaces, visual assets, and real-time optimized content.
- Enterprise VR adoption consulting, including readiness reviews, use-case planning, implementation roadmaps, and strategic recommendations.
- Project documentation, creative direction, technical planning, and written deliverables related to immersive experience development.
The exact scope of each engagement is defined in the applicable proposal, quote, statement of work, invoice, or written agreement.
3. Proposals, Estimates, and Project Scope
Any pricing, project duration, development timeline, or service description shown on the website is informational and does not represent a binding offer until confirmed in writing by Orbitalynx Labs.
Project work begins only after the applicable proposal, scope document, or invoice has been accepted and any required payment has been received. If additional work is requested outside the approved scope, it may require a separate quote, updated timeline, and additional payment.
- Deliverables are based on the agreed project scope.
- Timelines may depend on client feedback, content delivery, approvals, hardware access, testing windows, and third-party platform requirements.
- Changes to goals, technical requirements, target devices, content volume, or production complexity may affect cost and delivery time.
4. Client Responsibilities
You agree to provide accurate information, timely feedback, necessary project materials, technical requirements, branding assets, hardware specifications, and any internal approvals needed for the work.
- You are responsible for confirming that any materials you provide are lawful and that you have the right to use them.
- You are responsible for reviewing deliverables and reporting issues within the review period stated in the project agreement.
- You agree not to submit confidential, sensitive, regulated, or personally identifiable data unless it is necessary for the project and appropriate safeguards have been agreed in writing.
- You are responsible for determining whether the final deliverables are suitable for your operational, educational, training, safety, or commercial use case.
5. Payments, Deposits, and Cancellations
Payment terms are stated in the applicable proposal, invoice, or project agreement. Projects may require a deposit, milestone payments, or full payment before work begins.
Unless otherwise stated in writing, deposits and payments for completed work, planning time, design time, development time, consulting sessions, research, or delivered digital materials are non-refundable. If a project is cancelled after work has started, the client remains responsible for all work completed, expenses incurred, and reserved production time.
Late payments may result in paused work, delayed delivery, restricted access to project files, or suspension of services until outstanding amounts are resolved.
6. Intellectual Property and Deliverables
Ownership of final deliverables is governed by the written agreement for the project. Unless otherwise agreed, Orbitalynx Labs retains ownership of pre-existing tools, reusable frameworks, internal methods, templates, source systems, workflows, know-how, prototypes, and non-client-specific components used to create or support the work.
Client-provided materials remain the client’s property. The client grants Orbitalynx Labs permission to use those materials only as needed to perform the services.
- Drafts, concepts, rejected designs, internal notes, and unused production materials are not transferred unless specifically included in the project scope.
- Third-party assets, software, plugins, engines, platforms, hardware, licenses, or libraries may be subject to separate terms from their providers.
- Orbitalynx Labs may display non-confidential project descriptions or visual excerpts in its portfolio unless a confidentiality restriction is agreed in writing.
7. Confidentiality
If either party receives non-public business, technical, financial, operational, or creative information from the other party, that information should be handled responsibly and used only for the purpose of the engagement.
More detailed confidentiality obligations may be included in a separate agreement. Public information, independently developed information, and information already known without restriction is not considered confidential.
8. Limitations of Service
Orbitalynx Labs provides professional design, development, production, and consulting services, but we do not guarantee a specific business result, revenue increase, training outcome, adoption rate, safety outcome, certification result, or user performance improvement.
- VR experiences may depend on hardware performance, user comfort, platform compatibility, available space, headset settings, operating system versions, and third-party software.
- Clients are responsible for safe deployment, user supervision, internal training policies, and compliance with workplace or industry requirements.
- Consulting deliverables are informational and strategic in nature and should be evaluated by the client before implementation.
9. Website Use
You agree not to misuse this website, interfere with its operation, attempt unauthorized access, submit malicious code, scrape content at scale, impersonate another person, or use the website for unlawful purposes.
We may update, modify, suspend, or discontinue any part of the website at any time without notice.
10. Limitation of Liability
To the maximum extent permitted by law, Orbitalynx Labs is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from use of the website, project delays, third-party platform issues, hardware problems, client implementation decisions, or reliance on consulting recommendations.
Where liability cannot be excluded, it is limited to the amount paid for the specific service giving rise to the claim, unless applicable law requires otherwise.
11. Changes to These Terms
Orbitalynx Labs may revise these terms from time to time. Updated terms apply when posted on this page. Continued use of the website or continued engagement with our services means you accept the revised terms.
